Terms and conditions of business

Terms and conditions set out the terms of the purchase through the https://www.galerijaoskarkogoj-sp.si website (hereinafter referred to as "the Website") operated by Katjuša Kogoj Mužina s.p., Miren 125, 5291 Miren (hereinafter referred to as "the Provider").

By using and purchasing through the Website, the user accepts and agrees to all terms and conditions of business. All users use the site at their own risk. The buyer is bound by the general conditions that are valid at the time of purchase (placing an online order).

At the Oskar Kogoj Gallery in Miren we have many other products outside the online store program, so we kindly invite you to visit us personally and we will present you an even larger selection of products!

CONTRACT

The purchase contract is concluded when the Provider confirms receipt of the consumer’s / user's order by sending an e-mail to the user's e-mail address.
The purchase contract is concluded in English language. These terms and conditions are an integral part of the purchase contract.
The purchase contract (order) is stored electronically with the Provider and always accessible to the buyer upon written request.

ORDERING

The purchase contract between the online store and the customer is concluded in the online store at the moment when the online store sends the customer the first electronic message about the status of his order. From this moment on, all prices and other conditions are fixed and apply to both the online store and the customer. The customer is the person with the information as stated when placing the order. It is not possible to change customer data later. The condition for the purchase is the age of the buyer.
The sales contract (order) is stored in electronic form on the provider's server, and the buyer also receives an invoice at the entered e-mail address or by post upon confirmation of the purchase.
The sale is intended for natural and legal persons. Orders are accepted by email and web store. The order form must include: business address, exact delivery address, contact person, VAT identification number, telephone number and e-mail address. The signed order form has for a buyer and seller the status of contract.
The Provider will treat the accepted orders as irrevocable. In the event of a mistake or for other reasons, the buyer may withdraw from the order at no additional cost from the time the order is placed until the notification that the order is in progress. You can cancel your order by sending an email to oskar.kogoj@siol.net. If the Provider finds that he cannot execute the order under the above conditions, he may refuse the order.

PRICES

The published prices on the Website and the offers, the invoices issued are valid on the day of purchase, namely on the day of completion and placing the order through the Website. Prices do not have predefined validity.
In case of errors we reserve the right to make changes. Prices are valid in case of payment with the payment methods below, subject to the conditions specified. All prices are for products in stock.
Despite the efforts to provide the most up-to-date and accurate information, the pricing information may be incorrect. In this case, or if the price of the product changes during the processing of the order, the Provider will allow the buyer to withdraw from the purchase, while at the same time the Provider will offer the buyer a solution that will go to mutual satisfaction.
Prices are retail, include 22%, 9,5% and 5% VAT and are marked in EUR.
Prices do not include shipping costs, postage, printing, engraving, special unique glaze ... which is the subject of a special offer.
We reserve the right to change the price of products without prior notice.
Discounts do not add up.

PAYMENT METHODS FOR SLOVENIA

* You can pay the product bought at the Oskar Kogoj Gallery in Miren with cash or credit card upon pickup!
When shopping online, the provider allows the following payment methods:

* CASH ON DELIVERY
Cash on delivery is a payment in cash in a lump sum upon receipt of the package. Therefore, you must be present in person at the time of collection.
Cash on delivery is only possible if the user wants the ordered product from our sales range to be delivered to the selected address in Slovenia.
If you decide to pay by cash on delivery, the shipment will be delivered by the courier service between 8 am and 4 pm! If you are not available at your home address or at the address you left for the invoice, you can specify another delivery address when placing the order, as it is important to us that the shipment is delivered to the address where you are available or is available someone else who could pick up the shipment. If no one is available at the delivery address at the time of delivery, the courier will leave a notice of the shipment and where you can pick it up. In the event that the buyer does not receive the package within three (3) working days, the buyer must notify via e-mail to oskar.kogoj@siol.net.
Please note that the delivery service of Pošta Slovenije charges a fee for this type of service, which is not charged on the invoice.
Namely:
- for the amount up to € 98.00 charges a commission of € 1.05,
- for the amount from € 98.00 to € 501.00 charges 1.07% of the value and
- for the amount over € 501.00 charges € 5.36.
You pay a commission to the postman separately; the cost is not included in the value of the package.

* PAYMENT IN ADVANCE
The user can choose to pay to our business account. Immediately after placing the order, the user will be sent an e-mail notification of the summary of the accepted order, together with the information necessary for the transfer to our bank account. The invoice is received by the payer of the invoice and not by the recipient if it is another person.
The user undertakes to settle all his obligations to the transaction account KATJUŠA KOGOJ MUŽINA S.P., MIREN 125, 5291 MIREN within 8 days of receiving the pro forma invoice / invoice (date indicated on the invoice). If you make a payment, you are always welcome to let us know. After receiving your payment on our bank account, delivery will follow within the agreed time.

Allows payments with various credit cards. When you make a credit card payment, your order will be processed immediately. Once your card details have been verified and approved by the Bankart system, your package will be mailed.

* PAYMENT WITH CREDIT CARDS THROUGH THE PAYPAL SYSTEM

- You can use different cards when paying with PayPal
Paypal is a method of payment with VISA, Mastercard credit cards, which provides 100% security for the customer. Payment is visible on our PayPal account within a few minutes. If we do not receive your payment to our PayPal account within a few days, we will notify you by e-mail or by phone to the phone number you left when placing the order.

DISCOUNT PROMOTIONAL CODES

As a way of special promotion, users can also buy certain products with the help of discount promotional codes, which they receive in various ways (via SMS, on flyers, on social networks, published on the website …). The promotional code brings various benefits when purchasing and is time-limited. Codes and rules of use will be clearly defined. Any code is always limited in time, but must be redeemed within a limited time, otherwise it is invalid.

Use of discount code:
• Select the products you want to buy and put them in the cart.
Code entry is enabled for each product in the first step of the online order - Cart!
• In the CART under products there is an entry field "DISCOUNT CODE", enter the discount code and click the "USE CODE" button.
• Only one discount code can be redeemed for one purchase.
• When you enter the discount code, the value of the discount code is automatically deducted from the value of your order. The amount that still needs to be settled remains.


VALUE GIFT CERTIFICATE

A value gift certificate is a gift card / voucher issued by Katjuša Kogoj Mužina s.p. against payment sent to the buyer in physical form.
The value gift certificate can be purchased in the online store galerijaoskarkogoj-sp.si or physically in the Galerija Oskar Kogoj, Miren 125, 5291 Miren. The same provisions of the terms of business apply to the purchase of a gift certificate as to the purchase of other items. In case you need a voucher immediately, you can write to oskar.kogoj@siol.net for help. The gift voucher is valid for 12 months from the issuance of the voucher, unless otherwise stated on the voucher.
It is not possible to change the voucher for cash. The voucher is redeemable only in full; the difference in the value of the unused voucher is not paid out. In the event that the value of the purchase is higher than the value of the voucher, the voucher holder must pay the difference. The value of the purchase must be higher than the value of the voucher or equal to.
The gift voucher can only be redeemed at the Galerija Oskar Kogoj in Miren. A gift voucher with the stated amount must be brought with you to the Galerija Oskar Kogoj, Miren 125, 5291 Miren or send to Galerija Oskar Kogoj, Miren 125, 5291 Miren. DELIVERY OF GOODS AND COSTS FOR SLOVENIA

Goods ordered in the online store can be delivered to you by delivery service, but can be picked up at the registered seat of our sales gallery (when ordering please indicate your own pickup at the Miren Gallery) at the gallery opening time. Ordered products remain the property of the seller until the full purchase price has been paid by the buyer.

Goods ordered in the online store https://galerijaoskarkogoj-sp.si/, go on the way as soon as possible ¬– if in stock in our warehouse, in principle, the same day or within three days, or we will notify you in writing of delivery. In the event that you may have ordered goods that have just gone out of stock or which for unforeseen reasons cannot be shipped within the promised time, we will inform you of the new delivery time through given contacts. All products are handmade, so the delivery time is 30 to 60 days if the products are out of stock.
In order to deliver the ordered items as quickly as possible, we will always choose the most optimal route. This is usually a package delivery of Pošta Slovenije, which means that you can expect delivery the next day in the morning, if the order was placed by 1 pm, exceptionally the delivery time can take up to 3 working days. During the holidays and during the weekends, the delivery time for leisure days shall be extended accordingly. If you are not at the stated address at the time of delivery, you can pick up the package at your Pošta Slovenije unit, as the courier will leave you a notification of the shipment.

STANDARD DELIVERY cost across Slovenia is 6.90 EUR with VAT already included.
The cost of EXPRESS DELIVERY across Slovenia is 14.90 EUR with VAT already included. The order will be delivered by 1:00 PM on the next business day.
For purchases over 200.00 EUR, delivery in Slovenia is free of charge, but does not include EXPRESS DELIVERY.
The consignment is shipped with care, so the goods are safe when shipped!
The shipment is INSURED IN CASE OF DAMAGE!

If in the case of delivery of goods you find that there was a breakage in the shipment, you must notify us immediately – on the same day, or within three days at the latest. The buyer must initiate a complaint procedure with Pošta Slovenije. It shall do so by bringing the parcel to the nearest Pošta Slovenije unit in the same condition as it was received and completing the damaged shipment form.
Send a copy of the report on the damaged shipment, a copy of the invoice and your personal data to the company's address or to the e-mail address oskar.kogoj@siol.net. We will replace damaged goods at no cost to you as soon as possible! You must adhere to this deadline; otherwise we will not comply with the complaint.

The Provider reserves the right to choose another delivery service if this way fulfil the order more effectively.

CANCELATION OF ORDER BEFORE DELIVERY 

In case of an error when ordering via the Website, the user can cancel the order free of charge in writing to the e-mail address oskar.kogoj@siol.net before the written notice of delivery of the shipment.

RETURN OF GOODS FOR SLOVENIA

The goods must be undamaged, unused, in the same quantity and in the original packaging and sent to the address of our company, whereby the buyer bears the cost of returning the goods himself or brings them to the sales gallery. Shipment with payment on delivery is not accepted.
The cost of postage is not refundable and is not subject to complaint!
The customer cannot withdraw from the contract, the object of which is a product which has been made according to the precise instructions of the customer and which has been adapted to his personal needs (engravings, prints, special glazes, large quantities …).
Refunds will not be considered for products that have been damaged or used in your home. We reserve the right to refuse the return of a damaged, used or product that does not contain all the associated items (gift packaging, invoice …) upon return. Therefore, please handle the products economically and carefully as this is the only way we can replace the product.

Physically purchased goods can be replaced within eight days with the original invoice, and subsequent claims are not considered.
In the case of distance contracts, the consumer (according to Articles 43.č and 43.d of ZVPot) has the right to notify the company within fourteen (14) days to the e-mail address oskar.kogoj@siol.net that he withdraws from the contract, without he should be given a reason for his decision. The deadline starts one day after the date of receipt of the items.
All costs of uncollected goods or shipping of returned goods are on the side of the buyer.
The return of the received goods to the company within the deadline for withdrawal from the contract is considered a notice of withdrawal from the contract.
The buyer must notify the Provider on e-mail address oskar.kogoj@siol.net within 14 days of the intention to return the product, and the Provider will send instructions for return. The customer then has another 14 days to return the product to the address of the company. Otherwise, unfortunately, we cannot return the money.
The buyer must provide all the necessary information for a refund to the e-mail address oskar.kogoj@siol.net. He must state his name, surname, address, telephone number, a copy of the invoice, where he wants the purchase price to be returned to him – bank account number, opened at the bank ...
The buyer must return the goods to the company no later than 14 days after the notification of withdrawal from the order. The buyer returns the goods to the address: GALERIJA OSKAR KOGOJ, Katjuša Kogoj Mužina s.p., Miren 125, 5292 MIREN.
Upon receipt of the goods, the company returns all payments made to the buyer in accordance with the law. The buyer shall bear the following costs in connection with withdrawal from the contract or non-acceptance of the goods:
- postage (according to the price list of Pošta Slovenije)

Shipments with payment on delivery are not accepted and are rejected upon delivery.

Refunds will be made as soon as possible, but no later than within 14 days of receiving notice of withdrawal from the contract or return of goods. In order to ensure the certainty, accuracy and timeliness of the refund and to provide records of payments, the refund of the payment to the customer is made by transfer to his transaction account specified by the customer.

Upon withdrawal from the contract where a discount code or promo code has been used, these funds are considered a discount and are not returned to the customer. Only the maximum amount paid is returned to the customer's bank account.

The buyer may complain about the goods if the goods do not have the characteristics explicitly promised by the seller, if the seller sent the wrong products, in the wrong quantity, colour or otherwise deviate from the buyer's order.
The buyer can return the goods in the complaint by bringing it in person or at the seller's expense and by prior agreement with the seller return it by mail to the seller's address.
In the event of a complaint, the buyer may, in accordance with legal restrictions, request a replacement of the product or a refund of the purchase price.

In accordance with Article 37 of the Consumer Protection Act, the customer has the right to request that the company replace the defective product with a new faultless product or return the amount paid in the event of a defect in the product. The deadline for product replacement is 14 days. Replacement of products is possible only upon submission of an invoice or a copy of invoice.

Inspect the received goods immediately. In accordance with Article 37 of the Consumer Protection Act, the buyer has the right to immediately refuse to the courier who delivered the goods in the event of any damage to the product that occurred during transport. So don’t accept the shipment.

If in the case of delivery of goods you find that there was a breakage in the shipment, you must notify us immediately – on the same day, or within three days at the latest. The buyer must initiate a complaint procedure with Pošta Slovenije. It shall do so by bringing the parcel to the nearest Pošta Slovenije unit in the same condition as it was received and completing the damaged shipment form.

We will replace damaged goods at no cost to you as soon as possible! You must adhere to this deadline, otherwise we will not comply with the complaint.

DATA PROTECTION

E-news and consents relating to the receipt of e-news by galerijaoskarkogoj-sp.si follow the principles of transparency and careful handling of personal data in accordance with the General Data Protection Regulation (GDPR); ) and the Personal Data Protection Act.

You can find all the information on managing individual consents below. 

By filling out the application form for receiving the galerijaoskarkogoj-sp.si e-newsletter on current trends and news, the user agrees to provide the data, which in accordance with the law applies to personal data. In this case, these are: the email and IP address of the logging device. At login, the user has the opportunity to agree to the use of personal information for the following purposes:

The consent to receive the galerijaoskarkogoj-sp.si news about current trends and other news is valid until cancelled and includes:
• use of information to send regular e-news on current news;
• use of information to send other content from time to time, such as event notifications etc.;
• exporting, storing and processing data in a marketing automation tool that enables us to send these newsletters;
• processing data by pseudonymization (so that it cannot be attributed to a specific individual);

YOUR RIGHTS ON THE BASIS OF PROVIDED CONSENTS

An individual may at any time request the data controller to permanently or temporarily cease using his personal data for the aforementioned purposes. He may at any time make such a request to oskar.kogoj@siol.net, specifying which consent he wishes to withdraw.

It also has the following rights:
• Right to be aware of one's own personal data: an individual has the right to have his or her personal data collected in connection with him / her, to be acquainted with the processing and to verify their legality;
• Right to rectify or supplement to personal data: the individual has the right to have the galerijaoskarkogoj-sp.si correct his inaccurate personal data without undue delay;
• Right to erasure of personal data: the individual has the right to have the galerijaoskarkogoj-sp.si delete the personal data relating to it without undue delay, to the extent permitted by applicable law;
• Right to restrict processing: an individual has the right to restrict galerijaoskarkogoj-sp.si from processing personal data when it challenges the accuracy of personal data, when processing is illegal and instead of deleting personal data, and in cases where galerijaoskarkogoj-sp.si no longer needs his data for processing purposes, but needs to enforce, execute or defend his legal claims;

User is also aware that for the purposes of reliable identification in case of assertion of rights regarding personal data, the controller may require additional information from the user, and may refuse to act only if he proves that he cannot trust me reliably to identify.

User is also aware that upon request, the controller must respond without undue delay and at the latest within one month of receiving the request, upon requesting his rights in relation to the personal data mentioned above.

The Provider is committed to the permanent protection of personal data. These will be used solely for the purpose of sending information materials, catalogues, invitations, messages, offers, pro forma invoices, invoices and other necessary for communication. In no case will the user's data be disclosed to third parties or unauthorized persons. The user is also responsible for the protection of personal data by ensuring the security of his / her username and password when making purchases through the online store.

Only the user's delivery address and telephone number will be entrusted to the delivery service (e.g. Pošta Slovenije) if necessary.
Cumulative information will only be disclosed if so provided by law and in good faith that such action is necessary for proceedings before the courts or other state bodies, and for the protection and exercise of legitimate interests.

EXCLUSION OF LIABILITY

The Provider makes every effort to ensure that the information published on its pages is up-to-date and correct. However, the properties of the items, their availability and price can change so quickly that the Provider fails to correct the information on the web pages. In such cases, the Provider will notify the buyer of the changes and allow him to cancel the order or replace the ordered item.
The Provider reserves the right to disable or disable access to the Website due to technical or other problems and maintenance, which also means disabling or impeding the use of the Online Store.
The Provider is not responsible for compensation of any damage or costs incurred by the user due to the termination, inactivity or obstacles to the functioning of the Website – the Online Store. Provider does not guarantee the completeness and correctness of the content posted on the Website - the Online Store nor does it accept responsibility for the damage that the user may suffer due to the reliance on the published content.
The Provider is not responsible for any damage that may occur to the user's hardware, software or other equipment due to the use of the Website. The user must provide adequate protection of the equipment (antivirus, etc.) against access to the use of the Website.
The user must ensure the proper security and confidentiality of the information used to log in to the Website (e-mail, password). The Provider is not responsible for any damage that may occur to the user due to unauthorized disclosure or use of the registration information.
Although the Provider makes every effort to provide accurate photographs of sales items, all photographs must be considered as symbolic. Colour shades and appearance may slightly deviate from the true state of the products.

COMPLAINTS AND DISPUTES

The Provider complies with the applicable consumer protection legislation. The Provider shall make every effort to fulfil its duty to establish an effective complaint handling system and to identify the person with whom, in the event of difficulties, the buyer may contact by telephone or email. Complaints should be submitted in writing by email to oskar.kogoj@siol.net. The Provider will confirm within five working days that he has received the complaint, inform the buyer how long it will be considered and keep him informed of the progress of the procedure.
The Provider is aware that an essential feature of a consumer dispute, at least as far as court settlement is concerned, is its disproportion between the economic value of the claim and the costs incurred in resolving the dispute itself. This is also a major obstacle to the consumer from bringing a dispute to court. Therefore, the Provider shall use its best endeavours to resolve any disputes by mutual agreement.
